Call to Order

Chairperson Bob Voyles called the meeting to order at 7:05 p.m.

December 10, 2003 Minutes

The Committee approved the December 10, 2003 minutes on a motion by Joe Ladner, seconded by

John Gresens. Motion declared carried.

Jerry Laughlin

The Committee thanked Jerry Laughlin for 25 years of outstanding service on the Boat Committee and presented him with a plaque in appreciation of his many years of service.

2004 Mooring Lease Not Returned

Bob Voyles stated that the Watercraft Space Ordinance requires 2004 Mooring Leases to be returned to City Hall by December 15, 2003. He stated that those individuals who did not return their lease by the required deadline have the opportunity to present their case this evening before the Committee to explain why they were unable to adhere to the deadline.

Geoffrey Brown, 18545 Azure Road, Canoe Rack #20, St. Louis Bay – Mr. Brown stated that he has had his canoe rack for three years and did not have an excuse for not turning his lease in by the December 15th deadline. He stated that he had placed his lease in with his other bills and had simply overlooked it. He stated that it had been a very hectic time of the year with the holidays and with his job.

Gerald Cox, 3610 Laurel Drive, Slide #64, St. Louis Bay – Mr. Cox stated that he has had his slide for about four years and also did not have an excuse for not turning in his lease on time. Both he and his wife assumed the other had taken care of the mooring lease.

David Paulson stated that he was surprised that anyone would forget to turn in the material by the required deadline due to the tumult that the boating issue had caused last year. Ms. Cox stated that December is a very busy time of the year and the deadline was simply overlooked.

The Committee recommended that those individuals who did not return their mooring lease by the December 15th deadline should be informed that their permit has been revoked for the 2004 Boating Season on a motion by David Paulson, seconded by Steve Pavek. Motion declared carried.

Mr. Cox stated that he felt the Committee should give greater consideration to the fact that they cared enough about their boat space to take the time to come tonight. Bob Voyles stated that the Committee does give strong consideration to an individual’s explanation of the circumstances involved and the Committee did allow an individual to retain their space after he was able to demonstrate that he was in compliance with the 60-day usage requirement. However, it is difficult to accept an explanation where somebody simply forgot to turn the material in on time. John Gresens urged Mr. Cox and Mr. Brown to attend the February 2nd Council meeting because the Council could decide to reverse the Boat Committee’s recommendation.

Dana Young explained that the Watercraft Space Ordinance does not necessarily provide those individuals who have not returned their boat cards or mooring lease with the opportunity to appear before the Boat Committee or City Council to appeal the revocation of their permit. He stated that it has been the Boat Committee’s preference over the last several years to invite these individuals, just like those who are in violation of the 90-day rule or the June 15th deadline, to appear before the Boat Committee. He stated that there is a significant difference between those individuals who have not submitted their required material by the November 15th deadline and those individuals who are in violation of the 90-day rule and the June 15th deadline. The former poses an administrative burden by not submitting their material on time while the latter individuals are in actual violation of the Watercraft Space Ordinance. He suggested that City Staff could effectively deal with those individuals who did not return their material on time rather than placing the Boat Committee and City Council in the position of revoking their permits.

John Gresens stated that it might not be appropriate to deal with these individuals administratively because of the militant voices that were heard throughout the community demanding tougher enforcement action. Kim Crockett also added that the Council did not want City Staff to waste valuable staff time in the attempt to track down permit holders to submit the required information.

Further discussion was held regarding the upcoming October 1 – November 15 timeline that is given to submit boat cards and whether the timeline should be changed or shortened.

Motion to adjourn by John Gresens, seconded by Pete Onstad. Motion declared carried. The meeting adjourned at 8:00 p.m. The next regularly scheduled meeting of the Boat Committee will be held on Wednesday, February 11th.
