RESOLUTION NO. 22-07

 

 

IN RE:            The application of The Church of St. Therese, for a special use permit for real property located at 18325 Minnetonka Boulevard, Deephaven, Minnesota (PID No. 18-117-22 42 0001)

 

WHEREAS,  the applicant has made application to the City to operate a children’s day care facility within the existing school facility in the R-3 Residential District; and

 

WHEREAS,  the applicant proposes no additional signage above what currently exists on the property; and

 

WHEREAS,  notice of public hearing was published; notice given to neighboring property owners; and a public hearing held before the City Council to consider the application; and

 

WHEREAS,  public comment was taken at the public hearing before the Planning Commission on June 19, 2007; and

 

WHEREAS,  the City Council has received the staff report, the recommendation of the Planning Commission, and considered the application and comments of the applicant and the public.

 

NOW, THEREFORE, the City Council of the City of Deephaven, Minnesota, acting as the Board of Appeals and Adjustments, does hereby make the following:

 

FINDINGS OF FACT

 

1.      That the real property located at 18325 Minnetonka Boulevard, Deephaven, Minnesota (PID No. 18-117-22 42 0001) is a single lot of record located within the R-3 District.  This property is used for religious and educational purposes, containing a church structure.

 

2.      The applicant proposes to use only the sign area currently located on the property for advertising.  There will be no additional illumination the applicant’s signage other than what has already approved for the existing structure.

 

3.      The applicant proposes to use the existing parking area for the building to accommodate clients.

 

4.      Section 1305.02(1)(9) of the Zoning Ordinance permits children’s day care facilities as a special use in the R-3 District.

 

5.      The applicant has indicated that the hours of operation would be between 6:30 a.m. and 6:00 p.m., Monday through Friday.


 

6.      The Planning Commission voted unanimously to recommend the City Council approve the special use request to operate a children’s day care facility in the R-3 District.  The proposed use is consistent with the current use of the building and the proposal would not have detrimental affect on the surrounding area.  Commissioner Nelson seconded the motion.  Motion carried 5-0.

 

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Deephaven, Minnesota acting as the Board of Appeals and Adjustments:

 

1.      That the request for a special use permit to operate a children’s day care facility in the R-3 District at 18325 Minnetonka Boulevard, according to the plan submitted to Council be approved.  The proposed use falls under the provisions of the city ordinances and is consistent with other uses in the district.
