IN RE: The application of Amber Huttner, Good Life Yoga, for a special use permit for real property located at 18285 Minnetonka Boulevard, Deephaven, Minnesota (PID No. 18-117-22 42 0022)
WHEREAS, the applicant has made
application to the City to operate a Yoga studio in the C-1 Commercial
District; and
WHEREAS, the applicant proposes to use
the existing sign area for the proposed signage to advertise the business on
the structure; and
WHEREAS, notice of public hearing was
published; notice given to neighboring property owners; and a public hearing
held before the City Council to consider the application; and
WHEREAS, public comment was taken at the
public hearing before the Planning Commission on December 19, 2006; and
WHEREAS, the City Council has received
the staff report, the recommendation of the Planning Commission, and considered
the application and comments of the applicant and the public.
NOW, THEREFORE, the City Council of the City of Deephaven, Minnesota, acting as the
Board of Appeals and Adjustments, does hereby make the following:
1. That the real property
located at 18285 Minnetonka Boulevard, Deephaven, Minnesota (PID No. 18-117-22
42 0022) is a single lot of record located within the C-1 District. This property is used for commercial
purposes, containing a multi-tenant commercial structure.
2. The applicant’s tenant space
is currently vacant and no existing signage remains from the previous
tenant. The applicant proposes to use
only the sign area currently reserved for the space for her proposed
signage. There will be no additional
illumination the applicant’s signage other than what has already approved for
the multi-tenant commercial structure.
3. The applicant proposes to
use the existing parking are for the building to accommodate her clients.
4. Section 130.5.02(1)(94) of
the Zoning Ordinance permits physical culture and health services, reducing
salons and masseurs as a special use in the C-1 District.
5. The Planning Commission
voted unanimously to recommend the City Council approve the special use request
to operate a Yoga studio in the C-1 District.
NOW, THEREFORE, BE IT
RESOLVED,
by the City Council of the City of Deephaven, Minnesota acting as the Board of
Appeals and Adjustments:
1. That the request for a
special use permit to operate a Yoga studio in the C-1 District at 18285
Minnetonka Boulevard, according to the plan submitted to Council be
approved. The proposed use falls under
the provisions of the city ordinances and is consistent with other uses in the
district.
