A RESOLUTION
ESTABLISHING SPECIAL ASSESSMENTS FOR DELINQUENT
CHARGES
PERTAINING TO THE ABATEMENT OF A PUBLIC NUISANCE
WHEREAS, the City Council of the
City of Deephaven has caused a Notice of Public Hearing to be published in the
Lakeshore Weekly News on January 23, 2007 and January 30, 2007 that fixes the
time and place of a public hearing to pass upon the proposed assessment roll
for delinquent charges pertaining to the abatement of a public nuisance; and,
WHEREAS, the Notice of Public
Hearing has been given to all property owners whose property is to be assessed
therefore, by publication in the manner required by law; and,
WHEREAS, all persons have had the
opportunity to be heard in connection with said assessment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DEEPHAVEN, MINNESOTA, THAT:
1. The assessment roll, as prepared by the City Clerk, is hereby approved and the assessments therein contained are hereby determined to be the special assessments for the services therein included.
2.
Said assessments are found to be properly assessed upon the properties
so served.
3.
Each of such unpaid assessments shall bear interest at the rate of 8.0%
per annum accruing on the full amount from December 1, 2007.

Prior to certification of the assessment to the County Auditor, the
owner of any lot, piece or parcel of land assessed may at any time pay the
whole of such assessment, inclusive of the penalties, to the City Clerk, but no
interest shall be charged if such payment is made prior to certification to the
County.
5.
The City Clerk is hereby directed to certify such assessments to the
County Auditor for collection and remittance to the City Clerk in the same
manner as assessments for local improvements.
