RESOLUTION NO. 07-07

A RESOLUTION AMENDING THE CITY OF

DEEPHAVEN’S FLEXIBLE BENEFITS PLAN

WHEREAS, the City of Deephaven adopted a Dependent Care Flexible Spending Account and a Health Flexible Spending Account for its employees effective January 1, 2006; and,

WHEREAS, the Dependent Care Flexible Spending Account was originally established with a maximum annual employee contribution of $5,000.00 and the Health Flexible Spending Account was originally established with a maximum annual employee contribution of $1,000.00; and,

WHEREAS, the $1,000.00 contribution for the Health Flexible Spending Account was determined to be an appropriate amount for the first year the account was available but has now been determined to be inappropriately low an amount to effectively account for the reimbursement of medical and dental costs.

WHEREAS, it would be more advantageous to the City Employees to increase the amount of the annual contribution to the Health Flexible Spending Account too more accurately reflect eligible expenditures for medical and dental costs.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DEEPHAVEN THAT:

The amount of the annual contribution for the Health Flexible Spending Account is hereby increased to $4,000.00.

Adopted by the Council of the City of Deephaven this 5^th day of February, 2007.
